HomePoint, LLC ("HomePoint.com", "us", "we" or "our") created this Privacy Policy (the "Privacy Policy") in order to ensure the confidence of visitors and customers ("Users") of and to our www.HomePoint.com site (the "Site"), and to demonstrate our commitment to fair information practices and the protection of privacy. This Privacy Statement applies to personal information we collect online through our Site. It also applies to all data collection and usage for all HomePoint.com services. By using the Site and furnishing personal information to us, you are indicating your consent to our collection and processing of your personal information as described below.
HomePoint.com understands that your trust in our business is required to utilize our services. We appreciate your confidence, and make the protection and confidentiality of the personal information you provide to us a top priority. This Privacy Policy is a part of our overall goal of ensuring your confidence in our business.
What types of information do you collect?
HomePoint.com automatically tracks and collects the following information when a User visits our Site, including User's: (i) IP address; (ii) domain server; (iii) type of computer; and (iv) type of internet browser (collectively "Traffic Data"). Traffic Data is anonymous information that does not personally identify a User but is helpful for marketing purposes or for improving a User's experience on the Site.
In order for a User to access and use certain areas of the Site, HomePoint.com requires Users to provide us with information that personally identifies Users ("Personal Information"). Personal Information may include: (i) Contact Data (such as a User's name, mailing and e-mail addresses, telephone numbers); (ii) Financial Data (such as a User's account or credit card number); and (iii) Demographic Data (such as a User's zip code, age, profession or other employment data); and, (iv) Professional Data (for HomePoint.com Network members). If a User communicates with us by e-mail or otherwise completes online forms or surveys, any information provided in such communication may be collected as Personal Information.
When you purchase products from HomePoint.com or register for any HomePoint.com services, we automatically place you on our list to receive e-mail regarding updates, special offers, new data, and new services. If you do not wish to receive e-mail updates, please send an e-mail to Customer Care and type "Please remove me" in the subject line. If you have registered your personal information on the HomePoint.com site, you can login to your account profile and change the information. If you would like to have your account removed, please contact Customer Care or call us at 1-800-416-7949.
As a part of certain of our services, HomePoint.com compiles and stores data and information and generates reports related to User's access to and use of our services ("Service Data and Reports").
Are you using 'cookies'? What do you use them for?
HomePoint.com uses "cookies" for various Site features. Cookies are small files that are placed on your computer in order to transmit information back to our servers. Cookies allow HomePoint.com to provide you with customized content by collecting information about your activities on our Site. We may combine your voluntarily provided personal information with cookies in order to recognize you when you return to the Site. If desired, Users can block cookies by changing settings to decline cookies. Users may decline cookies, but they will not be able to fully experience the features of the HomePoint.com solutions and affiliated sites. Many features of the site may not function properly if the User declines to accept cookies. You can also manually delete cookies once they are placed onto your computer. We currently use two kinds of Cookies:
1) One Cookie generated by HomePoint.com tracks your experience on the Site, and protects you when using a computer that is shared with more than one person. We do not store any sensitive information inside the Cookie.
2) Another type of Cookie tracks your selections and will help us analyze which marketing methods work best. See the next two items for more information.
Can I turn the use of 'cookies' off and still utilize the services provided by HomePoint.com?
Unfortunately, the answer is 'no'. While you may browse the entire Site without the use of Cookies, currently you must have cookies enabled to order products or services from HomePoint.com.
Are you tracking my browsing behavior?
Our Site and newsletters have so-called Action Tags embedded in them. They allow us to see which methods of marketing work best and allow us to calculate the ROI (return on investment) for each method used. We do not engage in unethical marketing methods. In addition, we don't use these Action Tags to track individual browsing behavior and do not associate this information with individuals (customers) but rather use aggregate data to make decisions in terms of which marketing methods to use.
What does HomePoint.com do with the information collected?
HomePoint.com uses requested information to manage User accounts, process orders, deliver products and services, connect Users with industry professionals, notify Users about HomePoint.com and our products or services, to deliver promotional material from some of our partners, to respond to a question or request feedback, or to contact Users when necessary. HomePoint.com uses User's Financial Data to verify User's qualifications for certain products or services and to bill User for products and services. We use the User's Demographic Data to customize and tailor User's experience on the Site, displaying content that we think a User might be interested in and according to User preferences. HomePoint.com may use Service Data and Reports on an aggregate basis for such purposes as we deem appropriate. By using the Site, User consents to the collection and use of User's Personal Information and use in Service Data and Reports by HomePoint.com as described in this Privacy Policy.
With whom do you share collected information?
We may share personal information with partners, service providers, or third parties as needed to fulfill our service commitment to you and/or deliver products and services to you. In every case, we will strive to require said third party to use your personal information only to complete the necessary transaction. HomePoint.com will share only the personal information necessary to complete the required transaction.
In some instances, we may collect information that will be available to other Users of the Site. This applies in particular to real estate professionals and mortgage professionals who are members of the HomePoint.com Network. HomePoint.com Network members provide information regarding their business history and business volume which is available to view by other Users. We will disclose to you when any information provided by you will be available to view by other Users.
Do you sell or share any of the collected personal information with third parties?
Yes, we share your information as needed to connect you with a service provider, if you have requested us to do so. Creating a HomePoint.com account, ordering a HomePoint.com Direct or HomePoint.com Network service, or requesting information about a service provider will cause us to share your information with third parties. Depending on the product, service, or referral requested, we will share with others your name, address, telephone number and e-mail address. For HomePoint.com Network members, we will share your business information, including number of transactions in the last twelve months, your number of years in business, and your feedback ratings from customers and other members.
Do you send out so-called 'spam' or allow anyone else to send me unsolicited email?
The answer is simply 'no'. We do not send out unsolicited email, nor do we make your email address or other personal information available to other parties for the purpose of marketing, unless you have asked us to do so (such as connecting you with a HomePoint.com Network professional). People that receive our emails and newsletters have opted-in through our Site in most cases. If your email address is on our email list and you no longer wish to receive any newsletters from us, just follow the instructions at the bottom of the email to unsubscribe.
What are my choices regarding collection, use and distribution of personal information?
Users may choose not to provide HomePoint.com with any Personal Information. In such an event, Users can still access and use parts of the Site; however Users will not be able to access and use those portions of the Site that require User's Personal Information. You may also choose to remove your User information from HomePoint.com at any time. To remove your User information, you may contact us at Customer Care, or contact us directly by telephone or by mail at the address listed below.
How secure and confidential is my information?
Except as otherwise provided in this Privacy Policy, HomePoint.com will keep your Personal Information and Service Data and Reports private and will not share them with third parties, unless such disclosure is necessary to: (a) comply with a court order or other legal process; (b) protect our or our User's rights or property; (c) identify persons who may be violating the law or the rights of third parties; (d) cooperate with the investigations of possibly unlawful activities; or (e) enforce our Terms of Service. User's Personal Information is stored on secure servers. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, HomePoint.com has put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online that is under our control. HomePoint.com provides Users with the capability to transmit User's Personal Information via secured and encrypted channels if User uses a similarly equipped web browser.
What about children's privacy?
We don't knowingly collect personal information from children. Users of the Site should be at least 18 years of age. If you are under 18 years of age, please delete your account and stop using the Site. If you feel you have submitted what could be considered personal information for a person less than 18 years of age, please send us an email, and we will promptly remove the information from our system.
How can I change my personal information?
If you have an account on the Site, you may change your personal information at any time by logging in to the account using the 'My HomePoint' link at the top-right of the home page.
Login to your account, and choose "My Profile" to review and update your Personal Information that HomePoint.com has already collected.
What if my information is lost or stolen?
User must promptly notify HomePoint.com if User's credit card, user name or password is lost, stolen or used without permission. In such an event, we will cancel that credit card number, user name or password and update our records accordingly. Each user is responsible for maintaining the security of its own username, password and credit card information. Personal and financial information is not protected by this Privacy Policy when disclosed by the User to others through public channels.
What about third-party sites?
There may be locations ("Links") on the Site which redirect the User to other, third-party internet sites. HomePoint.com is not responsible for the privacy practices or policies or the content of such sites. This Privacy Policy does not apply to any third-party sites. You should examine the privacy policy of any third-party internet site before providing personal information. HomePoint.com has no affiliation with, nor control over, the data collection practices of third-party sites.
Does the Privacy Policy change?
HomePoint.com reserves the right, at any time and without notice, to add to, change, update or modify this Privacy Policy, simply by posting such change, update or modification on the Site. Any such change, update or modification will be effective immediately upon posting on the Site. Please periodically review the Privacy Policy on the Site to ensure the policy is in compliance with your own personal preferences.
